An overwhelming 90 percent of pedestrian accidents occur when someone walking is struck by a car. Unfortunately, many of these victims are children. Under Arizona law, a pedestrian is defined as "any person afoot."

In a recent national study, Arizona had the second highest pedestrian fatality rate (only New Mexico had more). Surprising as it may seem, walking can be dangerous here.

Right of way is a major legal issue in these cases. Pedestrians must obey traffic lights, but if the signals are not working, then the driver must yield: the pedestrian has the right of way unless there is a specific pedestrian walkway or overpass as an option. Pedestrians that jaywalk are a risk. Under the law, the vehicle has the right of way on that stretch of road.
